Ashurst Advises LONGi Solar on Foreign Subsidies Regulation Investigation

Ashurst represented LONGi Solar Technologie GmbH, a subsidiary of the Chinese group LONGi Green Energy Technology Co, Ltd, in the in-depth investigation carried out by the European Commission under the FSR Regulation.

On 3 April, the European Commission opened an in-depth investigation under the FSR Regulation into the consortium formed by ENEVO and LONGi Solar Technologie GmbH, which had taken part in a public invitation to tender for the design, construction and operation of a photovoltaic park in Romania.

Following the withdrawal of the consortium, the Commission announced the closure of its investigation on 13 May.

This is one of the first implementations of the FSR Regulation since its entry into force on 12 July 2023 and the second in-depth investigation opened by the Commission.

The Ashurst team was led in Paris by partner Christophe Lemaire and senior associate Guillaume Vatin, in Brussels by partner Donald Slater and in Frankfurt by partner Arne Fuchs.
